It is important to mention that this Lawsuit with Requested Connection: Preliminary Measures (File No. 8703/2001, August/2001) has been ongoing for over 24 years has been ongoing without resolution, surpassing the 20-year exclusive right period granted to the patent holder according to Argentine Patent Law, the Argentine National Constitution, and the International or Bilateral Agreements and Treaties on Industrial Property that the Argentine Republic has adhered or signed. During this time, legal tricks have been used [2] to obstruct and delay the justice process, which includes fair compensation for the damages and losses suffered by the innovators (PCSA and the Inventors), highlighting an unjust and impunity-ridden system.

Such damages and harms not only harm the victim, but also undermine the technological innovation system and the entire country as they have impeded the ability to export, license, or claim royalties on proprietary technologies in other countries, thus preventing the influx of capital from these activities and the opportunity to create jobs for our fellow citizens, as well as making new investments and conducting further research. At the same time, impunity, injustice, and harms are generated that destroy the security and confidence of the entire system.

Note [2]: Repeated requests from the defendant companies for actions lacking basis and inconsistents; Repeated submissions of baseless and inconsistent challenges that in reality do not contest the report produced by the experts -competent and honest professionals- and with verbal behaviors and transgressions that have sullied the honor of these individuals in their capacity as auxiliaries of Justice; Government agencies that delay or do not adequately respond to the Court’s requests; An incompetent and/or inexperienced first court-appointed expert in the field of Economics, who does not finish issuing a concrete opinion and excuses himself; and a second court-appointed expert in the same field issues an incomplete and biased report and is eventually removed from their position due to clear unethical conduct, as stipulated by their legal framework of action -Notification 24000076411395 dated March 5, 2024-; etc.
